From 10.04, the EES system has been launched in the EU. Airports no longer stamp passports and refuse to issue entry declarations for tourists. So far we are still managing to obtain stamps and declarations.

Declaración de entrada en territorio español — a document by which a foreigner independently registers the fact and date of their entry into Spain when that entry has not been officially recorded (no Spanish entry stamp).

For DNV cases: the declaration is a core document confirming presence in Spain at the time of application. Without it or an Spanish entry stamp, it is difficult to demonstrate that the person is physically in Spain on the date of submitting the residency application.

The declaration is required if:
In these cases there is no border control between Schengen countries — entry into Spain is not recorded anywhere, and the person must register it themselves.

Foreigners Regulation (RD 1155/2024): from 20 May 2025 the declaration can formally only be processed at Policía Nacional. In practice, in some provinces declarations are still accepted by Oficinas de Extranjería — check by specific city of submission.

If you entered from outside Schengen (Turkey, Georgia, United Kingdom) and received a Spanish stamp at the border — the declaration is not needed; the stamp already records the entry date.
